1. Definition and Interpretation

In these Terms and Conditions, the following words and expressions shall have the following meanings unless the context otherwise requires:

"Business Day" means a day (other than a Saturday or Sunday) when banks are ordinarily open for business in London.

"Contract" means the contract between SAE Media Group and you for the sale and purchase of the Event and/or the Event Material in accordance with Condition 2 below.

"Event" means any event or part thereof which SAE Media Group supplies to you under the Contract, including but not limited to live events and conferences and Virtual Events.

"Event Material" means any material related to the event which SAE Media Group supplies to you under the Contract.

"Force Majeure Event" means any event or circumstance beyond SAE Media Group's reasonable control.

"SAE Media Group"/"we"/"us" means SAE Media Group of India House, 45 Curlew Street, London, SE1 2ND (Company Number 03779287).

"You" means the company whose order in relation to the Event and/or the Event Material is accepted by us in accordance with Condition 2.2 below.

"Terms and Conditions" means these standard terms and conditions of sale together with any special terms agreed in writing between you and SAE Media Group as specified on the front of the acknowledgement of order.

"Website" means www.smgconferences.com

2. Formation and Incorporation

1. Subject to any variation to the Contract in writing and signed by a duly authorised representative on behalf of SAE Media Group, the Contract will be upon these Terms and Conditions, to the exclusion of all other terms and conditions, including any terms and conditions which you purport to apply under any purchase order, confirmation of order or similar document, whether or not such document is referred to in the Contract.

2. Each order or acceptance of a quotation for an Event and/or Event Material will be deemed to be an offer by you to purchase an Event and/or Event Material upon these Terms and Conditions. The Contract is formed when the order is accepted by SAE Media Group by way of a written acknowledgement of order.

3. No contract will come into existence until a written acknowledgement of order is issued by SAE Media Group.

3. Event Orders

1. 1. We reserve the right to decline any booking for an event. SAE Media Group requires payment to be made in full at time of booking via credit card. If payment is not made at the time of booking an event then an invoice will be issued and must be paid in full immediately prior to the event. If payment has not been received credit card details will be requested and payment taken before entry to the event. We are unable to allow a delegate to attend an event or have access to the Document Portal unless payment has been received in full by us prior to commencement of the event.

4. Replacement Delegate and the Cancellation, Rescheduling or Variation of an Event

1. You may substitute an alternative delegate with the delegate whose details have been provided with the order generally for no extra charge.

2. While we will try to ensure that the event goes ahead as scheduled, this may not always be possible. We therefore reserve the right to cancel or re-schedule an event and/or move the event to a Virtual Event for any reason at any time.

3. Upon cancellation by us , we shall provide you with a full refund of the amount paid by you to us within 14 working days of you requesting such in writing provided there are no other outstanding sums due to SAE Media Group from your organisation. Upon rescheduling by us or as the result of an Event being transitioned to a Virtual Event, all amounts paid by you to us will be applied to such rescheduled or Virtual Event at SAE Media Group’s option.

4. In the circumstances outlined in the above paragraph, except to the extent that we will refund you the sums paid by you to us in the event of cancellation, we shall not be liable for transportation, accommodation, loss of earnings or any other associated costs incurred by you or the delegate in respect of such cancellation or rescheduling of the event.

5. If you cancel the delegate's attendance at least 28 days prior to the event and are unable to send a replacement delegate, we will refund or credit (depending on whether payment has already been received by us) 50% of the fee minus a £50 administration charge within 14 working days of you requesting such in writing provided there are no other outstanding sums due to SAE Media Group from your organisation.

6. If you cancel the delegate's attendance less than 28 days prior to the event and are unable to send a replacement delegate, you shall remain liable for payment of the fee in full and will not be entitled to any refund. In such circumstances, the delegate shall be entitled to access to the document Portal at no additional cost.

5. Purchase of Event Materials

1. You may wish to purchase event material from us, which may include but not be limited to access to the document portal ,event presentation slides on CD ROM and the event transcription on CD ROM, and the prices for such event materials appear on the relevant booking form. In all circumstances, payment for such materials must be made in full at the same time as the order is placed. We do not accept cancellations of orders placed.

6. Intellectual Property Rights

1. All intellectual property rights in the event, the event material and the website remain the property of SAE Media Group and any copies made of event material shall be an infringement of copyright, unless agreed in advance in writing by us.

7. Data Protection

1. SAE Media Group gathers personal data in accordance with the Data Protection Act 1998 and you acknowledge by placing your order with us and providing delegate details to us, that we may use these details to contact you by telephone, fax, post or e-mail to inform you about other products and services of SAE Media Group.

2. You indemnify and hold SAE Media Group harmless against any claim being made by the relevant delegate that the delegate has not given his or her consent for you to pass on any personal data relating to the delegate.

8. Complaints

9. Liability

1. We do not warrant that the website will operate error-free or that the website and its server are free of computer viruses and other harmful code. If your use of the website results in the need for servicing or replacing equipment or data, to the maximum extent permitted by law we are not responsible for those costs.

2. All representations, warranties, terms and/or commitments not expressly set out in the contract (whether implied by law, conduct, statute or otherwise) are hereby excluded to the maximum extent permitted by law.

3. Subject to Condition 9.5 below, in no circumstances will we be liable for any loss of profit, loss of earnings, loss of anticipated savings, loss of revenue, loss of goodwill or for any indirect or consequential loss that you may suffer and which is caused by the event, the event material and/or the website.

4. Except in the above circumstances specified in Condition 9.3 above and subject to Condition 9.5 below, our maximum aggregate liability for any claim that you may have against us which is not otherwise excluded in these terms (including, but without limitation, where such claim arises as a direct result of (i) any negligent technical advice provided by us; or (ii) your use of the website) will be limited to the amount which has been paid by you with regard to attendance at the event or purchase of event material.

5. The exclusions and limitations of liability contained in these Terms and Conditions do not apply to any loss or damage resulting from death or personal injury caused by our negligence, loss or damages arising from our fraudulent misrepresentation, or any other losses which may not be excluded or limited by law.

10. Attendee Obligations

1. You procure that the attendee shall

1. Follow instructions and guidance given at the event, including any health and safety policies in place at the relevant premises;

2. Bring all possessions on to the relevant premises at his or her own risk, and we shall accept no responsibility or liability for such possessions while the delegate is attending the event; and

3. Not endanger themselves or others, be disruptive to other delegates or be excessively late at any point during the Event

2. You shall not be entitled to any refund in relation to attendees asked to leave the event for any applicable breach of Condition 10.1 above.

11. Indemnity

1. You agree to defend, indemnify and hold harmless SAE MEDIA GROUP and its partners from time to time being, its employees and agents, from and against any claims, liabilities, damages, costs, actions or demands, including without limitation reasonable legal and accounting costs, alleging or resulting from your use or misuse of the website or your breach of these Terms and Conditions.

12. Written Communication

1. When using our website, you accept that communication with us will be mainly electronic. We will contact you by email or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

2. All formal notices from you are required to be sent by letter. A letter shall be delivered at our registered office set out in Condition 1 above by recorded delivery post. If the notice is not returned as undelivered it will be deemed to have been given 3 business days after it was sent. We may give notice to you at either the e-mail or postal address you provide to us when placing an order, or in any way specified in Condition 12.1 above. Notice will be deemed received and properly served immediately when posted on the website, 24 hours after an e-mail is sent or 3 business days after the date of posting of any letter.

13. General

1. We will use reasonable skill and care in providing the services to you. However, we do not make any commitment to you that the event or the event material will meet any specific requirements that you have or that you will obtain any particular qualification from the event or the event material. You should take reasonable care to ensure that the event chosen will meet your needs.

2. Attendance by an attendee at an event or the purchase of event material is no guarantee of accuracy or integrity of material or information. The information provided at an event or in event material only constitutes the opinion of the relevant speaker(s) and should in no circumstances be a substitute for specific legal, financial or professional advice.

3. The Contract is governed by and will be understood in accordance with English law. Any dispute arising between us in connection with these Terms and Conditions shall be subject to the jurisdiction of the English courts.

4. The Contract constitutes the entire agreement between us in relation to the provision by us to you of the services or the purchase by you of the event-related material, and they replace and supersede any prior arrangements between us in relation to such.

5. The Contract is not intended to be for the benefit of any third party, and shall not be exercisable by any other person under the Contracts (Rights of Third Parties) Act 1999 or otherwise.

6. We shall not be in breach of the Contract or otherwise liable to you for any failure to perform or delay in performing its obligations under the Contract to the extent that such failure or delay is due to a Force Majeure Event.

7. Any clause in these Terms and Conditions that is found to be invalid or unenforceable shall be deemed deleted and the remainder of these Terms and Conditions shall not be affected by that deletion.

8. No waiver of any term in these Terms and Conditions shall be deemed a further or continuing waiver of such term or any other term.

Additional terms for all conference attendees

CONFERENCE ATTENDANCE:

Photography and filming at the conference

Audio or video recording and photography are strictly prohibited at the conference in all areas. By attending the conference you agree to your image and/or recordings of your voice being used in any media or materials created by SAE Media Group during or in relation to the conference, for any purpose commercial or otherwise.

SAE Media Group Press Pass

An SAE Media Group press credential is required for any video/audio recording or photography. Members of the press who wish to film, record or photograph at any conference must receive advance written permission from an authorised representative of SAE Media Group.

Those holding official SAE Media Group-issued press credentials may capture footage for media coverage purposes only. Video/audio/photographic capture of SAE Media Group sessions or the conference may not be used for marketing, advertising or commercial purposes without express written permission from both the conference session presenter(s) and SAE Media Group.

Your conduct at the conference

You agree: (a) to follow all instructions and guidance given to you by SAE Media Group or its representatives at the conference including complying with any health and safety policies in place at the relevant premises; (b) not to endanger yourself or others or be disruptive to other delegates; (c) that all possessions brought by you onto conference premises are at your own risk and SAE Media Group accept no liability for any loss or damage to your property or for any personal injury or illness caused or suffered in connection with your attendance at the conference unless caused by SAE Media Group's gross negligence; and, (d) that SAE Media Group have no liability, and you shall not be entitled to any refund, if you are asked to leave the conference for any reason by SAE Media Group or its appointed staff.

All conference documentation is the property of SAE Media Group or its licensors and may only be reproduced with prior written permission from SAE Media Group. If you wish to re-use any of the conference materials for any purpose commercial or otherwise, you must contact events@saemediagroup.com  prior to such use. Reproduction without permission for any purpose other than personal study amounts to copyright infringement.

Indemnity

The information contained in any conference material, presentations, papers, and any other information delivered by the speakers, and all opinions expressed, are those of the individual authors, speakers or delegates and not those of the SAE Media Group

SAE Media Group accepts no responsibility for the contents of any conference material and any use of, or reliance by you on them.

Supplemental Terms for VIRTUAL EVENTS:

"Virtual Event" means a virtual event to be held by SAE Media Group via the Platform on the Website;

"Platform" means the operating system environment on which the Virtual Event is held on the Website;

"Website" means the Virtual Event website made available by SAE Media Group on which the Virtual Event will take place via the Platform.

2. Virtual Event Responsibilities

2.1 SAE Media Group is responsible for the development and setup of the Virtual Event, the Website and the Platform.

2.2 You are responsible for any technical requirements to enable you to use the link to the Website provided by SAE Media Group and to participate in the Virtual Event via the Platform.

3. Virtual Event Representations and Warranties

3.1 You represent and warrant to SAE Media Group that:

(a) You will not undertake to create or introduce into the Virtual Event, the Website, the Platform or any part thereof any known spyware, virus, Trojan horse, logic bomb or other destructive or contaminating program; and (b) You will at all times comply with the provisions of all relevant data protection laws, legislation and regulations from time to time in force in respect of privacy and personal data protection.

3.2 SAE Media Group warrants that it will provide the Platform in a professional and workmanlike manner.

3.3 You must report promptly any error in or disruption to the Virtual Event and in any event within 48 hours of its occurrence. Your sole remedy for a breach of the warranty in Clause 3.2 shall be for SAE Media Group to correct any errors as soon as reasonably practicable and if there has been any disruption to the Virtual Event for a period of 24 hours to rerun the Virtual Event for an equivalent period.

4. Participation in the Virtual Event

4.1 The details of the Virtual Event shown in any material supplied by SAE Media Group to you are correct at the time of printing but you shall be responsible for checking with SAE Media Group that no alterations have been made.

4.2 SAE Media Group reserves the right in its absolute discretion to terminate your access to the link to the Website in the Virtual Event you and/or your employees and your exhibits whose presence in SAE Media Group 's opinion is or is likely to be undesirable without prejudice to any other rights or remedies available to SAE Media Group.

5. Indemnity

You shall defend, indemnify and hold SAE Media Group harmless from and against all costs, claims, demands, proceedings, liability, losses and expenses (including reasonable legal fees) whatsoever made against or incurred by SAE Media Group as a result of, related to or arising in connection with any acts or defaults of you, your employees or agents in connection with the Virtual Event.

6. Disclaimer, Exclusion of Liability

6.1 The Platform is delivered over the Internet, and accordingly, is subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications. SAE Media Group shall not be responsible for any delays, delivery failures, viruses, hacker intrusions or other damage resulting from such problems. Further, SAE Media Group shall not be responsible for (a) any occurrence or event outside the reasonable control of SAE Media Group; (b) any equipment or service failure where such equipment or service is not within the sole control of SAE Media Group; or (c) problems that occur as a result of any network failure or incompatibility.

6.2 SAE Media Group makes no representation, warranty, or guarantee as to the reliability, timeliness, quality, suitability, truth, availability, accuracy or completeness of the Platform. SAE Media Group does not represent or warrant that: (a) the use of the Platform will be secure uninterrupted or error free; or (b) the Platform or the servers that make the services available are free of viruses or other harmful components. All conditions, representations and warranties, whether express, implied, statutory or otherwise, including, without limitation, any implied warranty of merchantability, or fitness for a particular purpose, are hereby disclaimed by SAE Media Group to the maximum extent permitted by law.

 

 



WHAT IS CPD?

CPD stands for Continuing Professional Development’. It is essentially a philosophy, which maintains that in order to be effective, learning should be organised and structured. The most common definition is:

‘A commitment to structured skills and knowledge enhancement for Personal or Professional competence’

CPD is a common requirement of individual membership with professional bodies and Institutes. Increasingly, employers also expect their staff to undertake regular CPD activities.

Undertaken over a period of time, CPD ensures that educational qualifications do not become obsolete, and allows for best practice and professional standards to be upheld.

CPD can be undertaken through a variety of learning activities including instructor led training courses, seminars and conferences, e:learning modules or structured reading.

CPD AND PROFESSIONAL INSTITUTES

There are approximately 470 institutes in the UK across all industry sectors, with a collective membership of circa 4 million professionals, and they all expect their members to undertake CPD.

For some institutes undertaking CPD is mandatory e.g. accountancy and law, and linked to a licence to practice, for others it’s obligatory. By ensuring that their members undertake CPD, the professional bodies seek to ensure that professional standards, legislative awareness and ethical practices are maintained.

CPD Schemes often run over the period of a year and the institutes generally provide online tools for their members to record and reflect on their CPD activities.

TYPICAL CPD SCHEMES AND RECORDING OF CPD (CPD points and hours)

Professional bodies and Institutes CPD schemes are either structured as ‘Input’ or ‘Output’ based.

‘Input’ based schemes list a precise number of CPD hours that individuals must achieve within a given time period. These schemes can also use different ‘currencies’ such as points, merits, units or credits, where an individual must accumulate the number required. These currencies are usually based on time i.e. 1 CPD point = 1 hour of learning.

‘Output’ based schemes are learner centred. They require individuals to set learning goals that align to professional competencies, or personal development objectives. These schemes also list different ways to achieve the learning goals e.g. training courses, seminars or e:learning, which enables an individual to complete their CPD through their preferred mode of learning.

The majority of Input and Output based schemes actively encourage individuals to seek appropriate CPD activities independently.

As a formal provider of CPD certified activities, SAE Media Group can provide an indication of the learning benefit gained and the typical completion. However, it is ultimately the responsibility of the delegate to evaluate their learning, and record it correctly in line with their professional body’s or employers requirements.

Increasingly, international and emerging markets are ‘professionalising’ their workforces and looking to the UK to benchmark educational standards. The undertaking of CPD is now increasingly expected of any individual employed within today’s global marketplace.
